1Acceptance of Terms and All Legal Documents
By accessing or participating in FutureReady, CareerReady and FinishingSchool.LK (“the Programme”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not participate in the Programme.
📋 Comprehensive Legal Agreement:
Agreement to All Legal Documents: By accepting these Terms of Service, you acknowledge that you have read, understood, and agree to be bound by ALL legal documents, policies, and terms published by Center for Applied Research and Enhanced Learning (Skill Surf) and FinishingSchool.LK, including but not limited to:
- Terms of Service: These comprehensive terms governing program participation
- Privacy Policy: Data collection, usage, and protection terms
- Refund Policy: Financial terms, refund conditions, and payment policies
- Disclaimer: Liability limitations and important disclaimers
- Any Future Legal Documents: All legal documents published after your acceptance
Incorporation by Reference: All these legal documents are incorporated by reference into these Terms of Service and form part of your binding agreement with us. This means that by agreeing to these Terms, you are also agreeing to all other legal documents as if you had signed them individually.
Ongoing Agreement: You agree to review and accept any updated versions of these legal documents as they are published. Continued participation in our programs constitutes acceptance of any updated legal terms.
2Programme Disclaimers
The Programme is provided by Center for Applied Research and Enhanced Learning (Skill Surf), a registered non-profit organization in Sri Lanka. Participation in the Programme does not guarantee employment, career advancement, or specific outcomes. The Programme is designed to provide educational content and skill development opportunities.
No Guarantees: We make no representations or warranties regarding the effectiveness, accuracy, or outcomes of the Programme. Results may vary based on individual effort, background, and circumstances.
3Eligibility and Participation
The Programme is open to undergraduate students and recent graduates who meet the specified criteria. You must provide accurate and complete information during enrollment and maintain appropriate conduct throughout the Programme.
Conduct Requirements: You agree to participate respectfully, follow Programme guidelines, and not engage in any disruptive or inappropriate behavior that could interfere with other participants’ learning experience.
4Program Enrollment, Fees and Payment
Program enrollment is complete when the participant has been issued a username/password for online program access or sent program materials via another method. Program fees are non-transferable to other students unless specific permission has been otherwise obtained from the program supervisors. Fees (if applicable) will be stated at the time of enrollment. Payments may be processed by trusted third-party payment processors (e.g., PayHere) or you can upload your paid bank slip. We do not store sensitive payment details on our systems. You agree to pay all applicable fees and taxes associated with your enrollment.
Enrollment Terms:
- Full Payment Required: Participants are required to pay the full amount of program fees unless specific permission has been otherwise obtained from program supervisors.
- Non-Transferable: Program fees are non-transferable to other students without written permission.
- Student Discounts: If you choose to enroll using discounted pricing (e.g., student/undergraduate rates), Skill Surf may contact you for proof of verification after enrollment.
- Price Changes: Course fees and promotions are subject to change without prior notice. Discounts may have additional terms.
- Payment Accuracy: While we strive to ensure accurate pricing, errors may occur. We reserve the right to correct pricing errors and adjust charges accordingly.
⚠️ Important Notice:
Please be mindful to submit true and accurate information about your status, as false information will risk your eligibility for the certificate and may result in immediate termination without refund.
5Program Materials, Access and Assessment
All program materials are supplied in an online platform unless otherwise stated in the program description and are available for viewing online. The content of the online program materials, including copyright and all other such intellectual property rights contained therein, remains the property of Skill Surf.
Access Terms:
- Access Duration: You will have access to the online material on the platform for a period of 1 year or more up until the next intake of the program is announced, unless otherwise specified by the Skill Surf program team.
- No Reproduction: You may not reproduce any part of the online program materials without the prior written consent of Skill Surf.
- Intellectual Property: All program content, including copyright and intellectual property rights, remains the property of Skill Surf.
6Certificate of Completion Requirements
🎓 Certificate Eligibility:
- 100% Completion Required: Participants must have 100% completion (e.g., 4 out of 4) of assignments/homework to be eligible for certificates.
- No Final Exams: No final exams will be provided for assessing eligibility for the completion certificate.
- Assignment Tracking: Completion of assignments will be tracked through the online platform.
❌ Academic Integrity:
We do NOT tolerate any plagiarism in the assessments. Students who have been found to plagiarize or have any form of misconduct will not receive appropriate grades and may face immediate termination without refund.
No Attendance Monitoring: Participants will NOT be monitored on attendance, but must complete all required assignments to the satisfaction of program supervisors.
7Installment Plans
If the Programme offers installment plans, you agree to pay the total fee in predetermined installments by the specified due dates. The first installment must be paid to confirm your enrollment. You will receive a schedule outlining payment due dates.
Installment Terms:
- Payment Failure: Failure to make timely payments may result in suspension or termination of access.
- Non-Completion: Non-completion of payments may result in suspension or cancellation of your Programme access without refund of previously paid amounts.
8Class Rescheduling and Program Modifications
Unavoidable circumstances of resource persons may cause the cancellation of scheduled sessions, and in such situations, participants will be notified about the rescheduled dates via email or the official messaging group.
📅 Update Schedule:
Please be sure to check for updates on Friday night every week during the program timeline to stay informed about any schedule changes or rescheduling.
9Programme Modifications
We reserve the right to modify, suspend, or terminate the Programme at any time. This includes changes to content, schedule, instructors, or Programme structure. We will provide reasonable notice when possible, but changes may be made immediately if necessary.
10Intellectual Property and Program Protection
All content on our platform, including but not limited to text, videos, logos, program materials, assessments, Programme content, curriculum, course structure, learning methodologies, and educational frameworks, is protected under intellectual property laws and belongs to Skill Surf or its licensors. You may not copy, distribute, modify, reproduce, or replicate any content without prior written consent.

⚠️ Strict Program Replication Prohibition:
No Program Copying: You are absolutely prohibited from copying, replicating, or creating derivative versions of our programs, including but not limited to:
- Program Structure: Copying the format, flow, or organization of our programs
- Curriculum Content: Reproducing our course content, learning objectives, or educational materials
- Learning Methodologies: Using our teaching approaches, assessment methods, or educational frameworks
- Program Names: Using similar program names, branding, or marketing concepts
- Business Model: Replicating our program delivery methods, pricing structures, or operational approaches
Commercial Replication: Creating competing programs based on our intellectual property is strictly forbidden and will result in immediate legal action.
🛡️ What Happens If Someone Copies Our Programs:
Immediate Legal Action: If we discover that any individual or organization has copied, replicated, or created derivative versions of our programs, we will take immediate legal action including:
- • Cease and Desist Orders: Immediate demand to stop all copying and replication activities
- • Court Injunctions: Legal orders to prevent further program replication
- • Damages Claims: Pursuit of financial compensation for lost revenue and IP infringement
- • Criminal Charges: Pursuit of criminal charges for serious IP theft cases
- • Public Exposure: Legal right to publicly identify IP violators
No Tolerance Policy: We have a zero-tolerance policy for program replication and will pursue all available legal remedies to protect our intellectual property and business interests.
11Release of Liability and Indemnity
By participating in the Programme, you acknowledge and assume ALL risks and responsibilities arising from your participation, including but not limited to physical injury, emotional distress, financial loss, data loss, technical issues, internet connectivity problems, device failures, and any other harm whatsoever.
To the fullest extent permitted by law, you release from liability, hold harmless, and agree to indemnify Skill Surf and any partnering or collaborating organization, and their respective officers, directors, volunteers, employees, agents, heirs, successors, and assigns from and against any present or future claim, cause of action, loss, damage, injury, or liability of any kind whatsoever.
Comprehensive Release: This release covers all claims whether known or unknown, foreseen or unforeseen, including claims for personal injury, property damage, emotional distress, economic loss, loss of data, loss of opportunity, and any other damages whatsoever, regardless of the legal theory upon which such claims are based.

12Confidentiality and Privacy Policy
Skill Surf will make reasonable efforts to keep any confidential information that we have about you secure and to ensure that any of our employees or agents who have access to information about you do not make any unauthorized use, modification, reproduction or disclosure of that information.

- Secure Storage: We implement reasonable security measures to protect your confidential information.
- Limited Disclosure: We will only disclose information about you to the extent specifically required by law or for the purposes of this agreement.
- Third-Party Protection: Information provided by you is confidential and will not be divulged to any third party without your consent.
13Employment and Visa Disclaimer
Participation in the Programme does not create an employment, contractor, or agency relationship with Skill Surf or any partnering or collaborating organization. No wages, employment benefits, or visa sponsorship are provided by virtue of participation.
14Limitation of Liability
To the fullest extent permitted by law, Skill Surf will not be liable for any damages whatsoever, including but not limited to direct, indirect, incidental, special, consequential, punitive, exemplary, or any other damages, or loss of opportunity, earnings, profits, data, reputation, or any other intangible losses.
In any case, Skill Surf's aggregate liability under these Terms is strictly limited to the total fees paid by you for the Programme, and in no event shall exceed the amount actually paid. Nothing in these Terms excludes liability that cannot be excluded under applicable law, but to the maximum extent permitted by law, all liability is excluded.
14.1Enhanced Liability Protections
- No Guaranteed Outcomes: We provide educational services with varying outcomes based on the specific Programme. Some Programmes may offer no guaranteed outcomes. Any guaranteed outcomes are contingent upon full adherence to the Programme's learning agreement. Failure to meet the terms of the learning agreement may void any guarantees.
- Third-Party Service Protection: Skill Surf shall not be liable for any damages arising from third-party services, internet connectivity issues, device failures, or any circumstances beyond our reasonable control.
15Data Protection and Usage Rights
We process personal data in accordance with our Privacy Policy. Please review the Privacy Policy available on our website. Additionally, you are also subject to and must comply with the Privacy Policy of Skill Surf available at skillsurf.lk.
🔐 Comprehensive Data Usage Authorization:
By enrolling in our Programmes, you grant Skill Surf unlimited, unrestricted rights to collect, use, process, analyze, and utilize all data related to your participation for any lawful purpose whatsoever. This includes but is not limited to business development, research, marketing, partnerships, legal compliance, and any other organizational purpose we deem appropriate.
No Limitations: This authorization is perpetual, irrevocable, worldwide, and royalty-free. We may use your data in any manner we choose, including sharing with third parties, creating derivative works, and using it for commercial purposes without any restrictions or compensation to you.
16Cookie Policy and Data Collection
We use essential cookies and analytics tools to improve your experience and understand how our services are used. By using our services, you consent to our use of cookies as described below.

17Force Majeure
Neither party is liable for delay or failure caused by events beyond its reasonable control, including but not limited to natural disasters, strikes, war, pandemics, power outages, or internet failures.
18Governing Law and Jurisdiction
These Terms are governed by the laws of Sri Lanka. The courts of Sri Lanka shall have exclusive jurisdiction over disputes arising from or related to these Terms and the Programme.
19Code of Conduct and Academic Integrity
- You agree to maintain academic integrity and not engage in plagiarism, cheating, or any form of academic dishonesty.
- You must treat all participants, mentors, and staff with respect and professionalism.
- Harassment, discrimination, or inappropriate behavior will result in immediate termination without refund.
- You may not share Programme materials with unauthorized individuals or use them for commercial purposes.
20Complaints and Dispute Resolution
For complaints or disputes, contact reachus@skillsurf.lk. We will attempt to resolve issues amicably. If resolution cannot be reached, disputes will be subject to the jurisdiction of Sri Lankan courts.
21Emergency Procedures
In case of emergencies during Programme activities, contact emergency services immediately. For Programme-related emergencies, contact reachus@skillsurf.lk. We are not liable for emergency situations beyond our reasonable control.
22Changes to These Terms
We may update these Terms at any time, at our sole discretion. Changes are effective upon posting on this page unless a later date is stated. We are not obligated to notify participants directly. Your continued participation constitutes acceptance of any changes.
23Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
24Entire Agreement and Legal Document Integration
These Terms constitute the entire agreement between you and Skill Surf regarding the Programme and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written.

25Waiver
The failure of Skill Surf to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Skill Surf.
26Assignment
You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Skill Surf. Skill Surf may assign these Terms without restriction.
27Third-Party Beneficiaries
These Terms are for the benefit of Skill Surf and its successors and assigns. No third party shall have any right to enforce any provision of these Terms.
28Copyright and Intellectual Property Protection
All Programme materials, including but not limited to presentations, documents, videos, and assessments, are protected by copyright and other intellectual property laws. Unauthorized reproduction, distribution, or modification is strictly prohibited and may result in legal action.

- Creating Similar Programs: Developing programs that mimic our structure, content, or approach
- Using Our Concepts: Adapting our learning methodologies, assessment methods, or educational frameworks
- Copying Program Names: Using similar program names, branding, or marketing concepts
- Replicating Business Model: Copying our program delivery methods, pricing, or operational approaches
- Sharing with Competitors: Providing our program materials to competing organizations
Legal Consequences: Violation of these prohibitions will result in immediate legal action, including injunctions, damages claims, and potential criminal charges for serious IP theft.
29Communication Consent
By participating in the Programme, you consent to receive communications from us regarding Programme updates, announcements, and related matters. You may opt out of non-essential communications at any time.
30Programme Modifications and Updates
We reserve the right to modify Programme content, schedule, or structure to improve quality or address changing needs. Such modifications will not affect the core objectives of the Programme.
31Feedback and Programme Improvement
We welcome feedback to improve our Programmes. By providing feedback, you grant us the right to use such feedback for Programme improvement and development without any obligation to you.
32Additional Protections and Disclaimers
- No Professional Advice: Programme content is for educational purposes only and does not constitute professional, legal, or financial advice.
- Third-Party Content: We are not responsible for third-party content, links, or services referenced in the Programme.
- Force Majeure: We are not liable for Programme interruptions due to circumstances beyond our control.
33Survival and Cumulative Rights
Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, and indemnification obligations. Our rights under these Terms are cumulative and not exclusive.
